Many times they preemptively release them to avoid being picked up.
Second, they are not "holding them for additional days" they are being held now in violation of federal law.
The ones that really sicken me are the judges who sentence a felon to 364 days because if they serve a year they have to be deported. Those judges should be disbarred.
