Gibson’s, a restaurant and bakery near Oberlin College, can now collect $36 million from Oberlin for defamation over racism claims, according to a court ruling.

The Ohio Supreme Court made the ruling — the decision was 4-3.

4-3??? WOW!

The Ohio Supreme Court just refused to accept jurisdiction over Oberlin College’s appeal (the Court also refused to hear the Gibsons’ appeal seeking to reinstate the full punitive damages award). It was a 4-3 decision, and it means the Gibsons now can collect approximately $36 million.

Oberlin is a private university and not a government entity, so I don’t think they can hide behind the “We haven’t appropriated for a settlement” routine.

With the state ruling this way, I’m sure that the business should be able to get a court order demanding payment and threatening a freeze on the college’s accounts if they don’t make arrangements.

It was a 4-3 decision by the Supreme Court not to take the case, meaning it is a final judgment at the intermediate level. Doesn't indicate 3 supreme court judges held for the college.

Maybe the family should take a page out of Ron White’s book and demand facilities on campus they can call “Gibson’s big ol fricking building”.

Good. It’s not that bad, maybe. It’s 4-3 not to hear the appeal at all so that ends the case. The 3 who wanted to hear may have found for the college, but I hope not. I see no way the college should have won this one.

Now if we could just punish democrats for declaring us racists.

Politicians should be held to the same standard.

Heartbreaking 1st hand account from the bakery owner. What was done to this business and family is criminal.

I'm not trying to play the Internet tough guy, but I seriously question how some of these people don't go HAM and choke down the people trying to ruin their lives.

If they don’t pay within a couple months it won’t matter. The company can’t stay open even at their extreme bare bones level any longer than that.

Oberlin College is in an entirely different stratosphere of progressiveness.

It also costs upwards of 60k a year too.

Did you read that account from the wife - the only one left living? I now know what “literally shaking” means. It was infuriating.

You talking about the college or the bakery?

The college declaring bankruptcy means the bakery gets liquidated damages when assets are divided.

The bakery declaring bankruptcy doesn’t mean the judgment goes away. It just means they no longer have the business in question.

The bakery. But read the piece I posted above. The father and husband died waiting for this to be over so the only thing left for the mom and son is their promise to keep the doors open. They don’t care about the money other than keeping the 137 year old bakery open.
