Why President Trump Can't Directly Order National Guard Troops To U.S.-Mexico Border

quote:

President Trump wants military troops to help guard the U.S.-Mexico border, but there are legal limits on what the military can do. NPR's Audie Cornish speaks with George Mason University law professor Tim MacArthur about the Posse Comitatus Act.

quote:

The Posse Comitatus Act prohibits theuse of federal military personnel to "execute the laws"; however, there is disagreement over whether this language may apply to troops used in an advisory, support, disaster response, or other homeland defense role, as opposed to domestic law enforcement.

This is what the article is using for evidence which is false news

So President Bush and Obama can order troops to Syria without declaring war, but Trump can't deploy the NATIONAL GUARD to move from Louisiana to Tejas in order to GUARD our NATIONAL border?

Not sure it applies here. Posse Comitatus prevents use of the Army and Air Force on American soil to enforce domestic policy.

This issue seems to fall far outside domestic policy.

This guy has a history of anti-TRUMP op ed pieces. He's another of those former millitary guys who's turned neoliberal or full on cuck like tiny Adam Kinzinger.

Don't matter.

Emergency declaration trumps it all.

See my thread for the verbage.

I would argue that immigration is a foreign policy issue thereby falling under the exclusive jurisdiction of the executive branch and that border control calls under immigration policy.

So we're sending the national guard to stand around with no weapons and protect the border from what, exactly?

I just don't get the hard on for this. We have a border patrol.

It's a blatant misuse of the military.

I think it has something to do with 187D chess....I barely know what direction the horsey goes. So, it is beyond my comprehension.

If the military's intended use is not to protect the US civilian and our national sovereignty, then what is it for?

.

How so? A lot of countries use their militaries in border control.

Legal issues aside, I'd much rather have our troops at our Southern border the fighting on the wrong side in Syria.

So protecting the borders of our country is not something that the military should be doing?

You probably think their purpose should be to pay for dudes to get their dicks cut off and wear dresses.

Dumbass.

Their role isn't to enforce immigration policy. You are calling it protecting but we both know it is law enforcement.

This is ignorance on display; let me guess, the military should be used to help the spread of HIV while incorporating transgenderism?
