I doubt they would go to jail for simple assault. If this is a hoax (big if) it would be worth it for Jussie's agent to slip them $50k apiece. Could probably plead to a misdemeanor each.

If it's a hoax, why would he need to pay them off since they would be a part of the hoax?

To plead guilty to protect Jussie. Thought that was obvious.

The only reason I think it might not be a hoax is that the two have a reason to be there at that time since they were going on a flight in a few hours. Perhaps Jussie came on to one of them on the set of Empire and that triggered a homophobic reaction. Would explain the "follow" on social media and how Jussie was quickly recognized.

It is going to be difficult to charge them with a conspiracy without some phone or email communication or one of the two guys confessing. If the two guys say they saw Jessie on the street and decided to rough him up a bit, you really need some sort of evidence to show they weren't in some arrangement with Jussie.
