I appreciate your posts, and have the same politics as you. But, that doesn't mean we should ignore reality.

For instance, state bar associations are notoriously liberal. I hate what they did to Rudy Giuliani. In this case, I think Magistrate Fitzpatrick is correct...but even if he weren't, there's no way he would be disbarred in blue Virginia.

The sabotage was having an inexperienced person handle this herself on a short deadline while basically the entire department said it was a bad case.

If you described the hearing to me and sanitized the names using random ones from a phone book and asked me my opinion, I would say the prosecution was horribly inept or trying to tank the case. If you then told me the Halligan character had zero trial experience, I would change my opinion and tell you whoever appointed her was inept or trying to tank the case.

There is zero reason to have people who can't meet EC 1-1 for competency in this arena to be handling this case. Anyone who thinks Comey should have been indicted should be ready to punch a wall right now.

No, what you meant is Halligan is not a “criminal prosecutor” in any (traditional or not) sense of the word. When you can’t get an actual prosecutor to file charges and you go get an unqualified beauty queen, you don’t think mistakes will be made. Some of you are amazing, and not in a good way.

There is a possibility that the idea was that even if the indictment was dismissed, it would toll the SOL and give the prosecution the normal 6 months to refile. The problem is that no true indictment was ever returned. There is nothing to dismiss; it literally never existed. There has been nothing done that would toll the SOL, so the prosecution is SOL. Filing an indictment with the court that Halligan was aware had never even been seen by the full GJ is a potential disbarment level offence.

I'll just repeat again, it's telling that Mike Davis, Julie Kelly, Jonathan Turley, etc. STILL haven't commented on that hearing yet.

They can't even create the slightest spin on this story yet, 8 hours later

You think Turley is partisan? He seems objective to me. I don't always agree with him, but he seems sincere...unlike the other two.
