The correlation of someone being innocent until proven guilty and having right stripped because an indictment was obtained? I mean, do you realize how easy it is to get an indictment?

A person who is arrested and held without bond is still "presumed innocent" as well. Yet, they've had a lot more rights stripped from them.

Trump can still publicly blast Biden, DOJ, leftist, etc. Just leave the names of people involved in this particular court proceeding out of it. Not hard or overly burdensome.

Forgone conclusion does not resemble justice.

That’s not what I said. I said it is very easy to get an indictment. That is just a fact. If the prosecutor wants a true bill they will get a true bill.

Isn't that what happened in this case?

Yep. Prosecutor wanted a true bill and got it. It is clearly politically motivated. It’s a shame people defend what is happening.

Agree 100 percent.

Understood. I still don’t like a politically motivated prosecution. There are lots of laws I disagree with, but they are what they are and prosecuting those are different to me than a 100 percent politically motivated prosecution.

understanding is that the overwhelming majority of federal indictments end up pleading guilty or being found guilty. Even if you only look at the ones that don't plead out and go all the way to trial, roughly 95% get found guilty.

Numbers are slightly different

About 89 percent plead guilty
About 9 percent get dismissed

That’s rounding up a bit, but of those that go to trial, about 83 percent are convicted (actual is about 1.9 to 0.4 of all defendants) Pew

Nevertheless, that isn’t the totality of the point. Regardless of the reasonableness of a gag order, defendants lose rights to speech on being indicted, not on a trial. Thus any restriction on the speech should be very narrowly tailored. Threats, direct intimidation, etc do seem to be out of bounds. Insults, discussions of motivation etc can be impolite, but they should be on the allowable range of speech

This is nothing like a normal federal case. In fact, Jack Smith has gone after a political opponent in the past and was slapped down 9-0 by the Supreme Court and admonished for his actions. If you want to look at precedent, that beat down is much more on point.

I'd be willing to bet you don't know a lot about that case other than what you've heard on fox or talk radio. The politician and his wife received money and gifts and vacations from someone trying to get approval for a product. Jack Smith got the conviction because it was shown that in exchange for all these gifts, the politician setup meetings with officials and tried to influence people to allow the product. The supreme court determined that without a direct quid pro quo involving an "official act", not just setting up meetings, but an actual vote or something of the kind, you can't convict someone for corruption. In reality this guy was doing very shady and immoral stuff. The supreme court even stated so in their opinion.

Where did you see that he was admonished by the supreme court? I haven't seen this claim anywhere.

> roughly 95% get found guilty.

2.3% of all federal indictments go to trial, and 1.9% of all federal indictments (all federal indictments not all that go to trial) result in guilty a finding
that works out to about 82.6%

You don’t think lawfare is a tyrannical act?

I am curious if there is a way to find out if law fare had any communication with the justice department / smith.

If so, I don't think any restrictions on speech is appropriate as it relates to all involved parties

It is not unusual for
a judge to place limits on public comments by a high profile criminal defendant. There are conditions on his pre-trial release. That’s normal

For frick's sake...this isn't a goddamned car thief. It's a fricking political candidate for President who will have his opponents saying all sort of shite about his "problems" as well as "leaks."

She puts restrictions on fricktard Smith's office and his people and threaten to put HIM in jail if the media gets any scoop, then we can talk.
