And SCOTUS, heck even the 10th Circuit or possibly the residing federal judge in liberal DC would tell the DOJ to GTFO with that argument. The CiC just has all the liberty in the world to declass as they see fit, as they should. Taking that power away officially states there is a fourth branch of government (the administrative state) in which the executive branch only has limited control. The administrative state is part of the executive branch, not a separate branch. This is the primary reason so many things are frick up in DC. Presidents give the administrative state that works for the president too much power and they don't let go of that power from administration to administration.

For example when we gave the administrative state more power with the Patriot Act and Homeland Security it was fine under GWB. They were producing FISA warrants against potential foreign terrorists. Under Obama they turned their attention to domestic political enemies while the FBI and Homeland Security worked with Twitter to censor our speech. Meanwhile, as the 4th branch grows power not even the president can tell them to stop and they are supposed to be working for him.
