You would have likely have had to prove that that was their intent. While it was, convincing others beyond a doubt would be more than difficult.

I kinda see your point, but the INTENTIONAL tort is probably the deciding element, IMO.

Again, of course, I have trouble seeing a lot of liability on even the negligence. But plaintiff's lawyers (I was never one) tend to have trouble accepting that there is any such thing as an unforeseeable accident.
