Perjury is willfully telling a lie. If Trump told them a lie and they repeated it, he's the one who is falsifying (which is in the indictment) and they aren't guilty of perjury.

Anyone who has skimmed the indictment can see that its not charging crimes related to taking. That's the point and that's why comparisons to all the other folks who took docs don't matter a whole lot.
The indictment is about keeping the docs and misleading and failure to return the docs.
So Yoo's comments aren't all that useful or interesting.

The DOJ gave an air of criminality to things that weren’t criminal to pursue a legal case against Trump. Anyone who can’t admit that isn’t part of a serious discussion.
