Part of the problem you would find with this tactic are morals. A lot of conservatives who may loathe a democrat would not find them guilty unless it was a slam dunk. As much as they may despise the individual, their conscience would not allow them to find them guilty if it was shaky. In many cases, the other side does not give the same consideration.
