Unless the 2 parties battling in our court system are equally matched in terms of funding to spend on legal fees, it usually has a lot to do with how much you can spend on lawyers.
She isn't a victim of anything. She is a publicity seeker and this is of her own doing. She is way past her prime making money in porno or whatever else she was doing. Late night talk shows don't pay.
