I understand what you are asking, but it is not that simple. For example....criminal history of the defendant can not determine guilt or innocence. BUT it can and SHOULD come into play at sentencing.
I can tell you from the area that I work Law Enforcement in.....Black Males are committing crimes at a higher rate (per capita) than any other demographic.
I have arrested MANY white individuals for a variety of offenses.......but I can tell you that I have never (at least to my recollection) had a white offender pull the race card to me (or even my black co-workers).
I have been accused of being a racist, even having solid evidence that the suspect had committed the offense.
I am a constitutional conservative, so I surely hope that judges are using the parameters set forth by the constitution to hand down sentences. If not.......
