quote:Kelly is unique in that group because he did actually retire, and is on a pension. The others left service early as far as I can tell. Military retirement is subject to recall to active service. It is a well known issue for military members. There maybe legal questions regarding a recall and prosecution of actions Kelly took as a "civilian," but IMO, he'd be in serious trouble. He was incredibly stupid to pull this mess.
No, he can't.

quote:Of course retired military officers can be recalled to active duty in a time of emergency, like an impending war, but the military does not have the authority to prosecute civilians for any crime they commit as a civilian unrelated to their military service.
It is a well known issue for military members.
If the military could do that it would usurp our entire structure of law that the military is subjugated to civilian legal process.
EDIT:
quote:
Can the military prosecute American civilians who have committed non-military crimes?
No, the military cannot prosecute American civilians for non-military crimes under normal circumstances, as civilians are typically subject to civilian law.
However, there are limited exceptions, such as during a declared war or in specific situations involving civilians who are accompanying, employed by, or married to the armed forces, and are stationed outside the continental United States.
In these cases, military courts may have jurisdiction.
For crimes committed on a military installation or federal land, civilian courts can prosecute, sometimes with the assistance of military legal personnel appointed as Special Assistant U.S. Attorneys.

Agree. Just responding to someone claiming I was brainwashed regarding name calling.
Who’s name calling. And who is brainwashed to it.
Who’s name calling. And who is brainwashed to it.

He's a puppet, nothing more!!!. Trump has him by the balls and that's how he wants it.. We the People deserve a leader with a vision, only problem the leader would clash with Trump so you get what we got, an inexperienced pretty boy!!

Hegseth better get busy! Every fricking day that the Sedition 6 and their puppeteer's are not in handcuffs and jailed is just one more day their treasonous rhetoric puts our Military in jeopardy.
But Trump has long-established that he does not care in the slightest about filing and losing meritless court procedings. He may yet do it.

quote:It is not remotely any of those things, though he did arguably violate 18 USC 2387 (encouraging military insubordination). But that claim is so marginal that no civilian lawyer would pursue it, for fear of the sanctions for a meritless lawsuit.
He openly stated that "this administration is using troops against American citizens" which is patently and demonstrably false. He should 100% be recalled, court martialed and imprisoned for sedition. It's an actual call for insurrection, military coup and borderline treason.

Time for being rational is over. You need to prepare yourself for that, especially if you are fricking muslim filth..

Kelly retired in 2011 from the navy and is not in the military reserve.
I retired from the Army in 2007 and am still a part of the Retired Reserve.
Kelly is getting a pension, he's part of the Retired Reserve and can be recalled to active duty and court martialed.
