If Sullivan does lose, then does he appeal to the entire DC Circuit en banc? He'd likely have a good shot to win there.

It's a good question, was thinking about how bad he wants Gen. Flynn's blood. Will he apply for a writ to SCOTUS? To be honest, this is such a bizarre situation. I've litigated writs of mandamus before, but never against a court.
What would he be fighting for so hard if not his purely partisan and personal vindictiveness against Flynn, which he previously demonstrated in open court when he accused him of treason?
How could it be the integrity of the court? It can't be the integrity of the executive or that would expose his utter bias... it boggles the mind.

I think it'll be a 3-0 case and no en banc appeal will be pursued. The Supreme Court just ruled unanimously on this type of issue weeks ago. And beyond that, the amicus appointed wrote a biased op-ed and is law partners with a guy who represented Sally Yates.

It’s almost like somebody has some dirt on him...possibly from a govt database of all communications....and he’s willing to risk his whole career rather than have that leaked out.

he has a history of protecting family members and/or friends from legal issues...in the swampy type of way.

Nope. You don’t understand what a lifetime appointment means. Unless he commits an impeachable offense, a federal district court judge can do anything he wants. He can be reversed by the appellate court every single time and continue merrily on his way.

I believe this to be the legal issue. A thousand years of common law have repeatedly upheld the maxim that a court considers only the evidence and issues before it. It does NOT introduce argument, evidence, NOTHING. Otherwise, the Court is either a witness or a party, and then where does one turn for an impartial tribunal?
