yes
i literally posted a 9-0 decision slamming Obama's NLRB appointments where essentially this happened
the point of separation of powers and checks and balances is to allow branches to stall the other branches from action
this is like 2nd grade civics

No. If Hillary had won, and every poll and pundit thought she would she would have been doing the nominations.
