Feel free to point to the part in the Constitution that defines a traitor and says the Confederates don't fit that definition.

Article III defines Treason.

None were tried, much less convicted.

Jefferson F. Davis wished to be tried; but the SC advised against such, for fear he would be found not guilty.

He was part of a blanket pardon by Johnson. Stop trying to rewrite it.

This is where you bombed out, both of you. They were all American soldiers. The Union soldiers were Americans and sons of the south were soldiers of the Confederate States of America.
And actually, there was no United States of America. That ceased the moment of secession. All that was left was a Union of northern states. During the war it was Union and the CSA, all were American soldiers!

What do I think? I'm thinking, "why won't he answer the question?" You said people that kill American soldiers are traitors. I'm assuming that you are just talking about confederates. So I am asking you, just to clarify, does that mean American Indians are traitors as well? It's a simple yes/no answer.
