Trial judges usually like to let trials take place. I would not guess beyond that maxim. An appellate court could act on it later if there is a conviction, but not vice versa
As a matter of efficiency, the court is better positioned to allow the appointment to stand. As you mention, there are collateral effects to finding the appointment invalid. Nevertheless, the times was reporting that the James indictment was a rogue action by Hallogan and without the knowledge and consent of Justice. NYT

This is really the only punishment we can hope for. Any real jail time will be icing on the cake, but not expected.
Each time he does something like this I think about how much it cost him, and it makes me smile.
Though I wouldn't be surprised if he's getting the money from some supporters.

No way will they let him go broke. The swamp will probably Pro Bono him. Comey is a psychopath that will write a book.

Thanks for the reply. I tend to agree that the Court won't shut it down based on this.
I also saw the reporting about how the James indictment was done by Halligan without input from main DOJ. The James indictment is so much more professional than the Comey indictment. That's an encouraging sign that either Halligan has some secret prosecutorial skills OR is getting effective help from someone willing to actually do the heavy lifting.

Ok -but aren’t the appointments good for a period of time regardless of approval? What’s the legal impediment to her signing an indictment?
