And your opinion is fine. But making a definitive statement about what would happen in court is rule #1 litigators stay away from. If you litigate, you know ANYTHING can happen in court.
I have lost cases where the law was absolutely clear…but the state judge didn’t like it. You don’t think that can happen in federal court? I was a clerk for a federal judge. It’s much more subjective than you think. And that doesn’t even take into account to consideration a jury is made up of lay persons. That’s why I say you aren’t a litigator. No litigator makes definitive statements.

It just means "I wouldn't change my testimony." The burden would be on the prosecution to prove that he would have changed his testimony. Not sure how they would do that ( in the unlikely event this case makes it to trial ) without Comey testifying.

Not to you BB, but a general comment.
I'm using this thread as a example to grandson showing how a hand full of lawyers can frick around the bush for 3 hours and and accomplish absolutely nothing.

Though it is a good lesson. SFP and I disagree on this. I respect him. I think he respects me. And we can argue non stop about it. It is what happens in court all the time. Rational minds can disagree.
Though I wish I could bill for my time here.

Summer after 1L year I had him for admin law. He announced he didn't do the participation adjustments and I was already not reading for class. Before class he asks me if I did the reading and I said no. When he starts class, "Mr. SFP, what did you think about x-case?" to embarrass me.
Little did he know not only how little of a shite I gave (other than not reading anymore I had my grades that made failing out impossible), but other people in the class knew that, too.
So I just immediately replied, "I told you before class I didn't do the reading" and like 10 people laughed at him and a bunch got upset for him for trying to embarrass me. Safe to say I did not get a good grade in that class.

Actually, upon reflection, discussion with you AND the fact that Comey's attorneys didn't raise it their motion to dismiss (linked above), I'm coming around to THIS issue not being fatal to the indictment.

I don’t blame them though. I taught an undergrad commercial law class. And I just didn’t care. I’d imagine that’s where they are at.
