Not required. As I mentioned. I would have added a sentence clarifying it…but the requirements were met. Unless you allege Comey doesn’t know what he is being charged with and why.

Well as we said, the lie part is still up for debate.

But "standing for" a lie is not the same thing as lying in testimony. There is a distinction. Like I said, vicarious perjury, which is apparently a new concept.

Didn't Comey lie about it later than in 2007 in sworn testimony? If so, the statute of limitations extends from the latest lie.

Anyhow, sorry for getting hot under the collar. I'm just blown away by the incompetence of shown in the indictment. Not many others are surprised. I can live with that.

You know I respect you as a person and as an attorney. I’ve seen you in court. You are a skilled litigator.

So I ask this earnestly. Is saying “I stand by my testimony” not a restatement of that testimony in your opinion?

The last alleged lie under oath was the 2020 testimony he gave to Ted Cruz which is the subject of this thread.

Not specifically. Cruz asked a bad question and Comey answered it vaguely. Cruz could have just followed up with, "so you're testifying today that your testimony in 2017 was truthful?" in a more direct way and made him commit.

Just like the adoption argument. All Cruz had to do was ask him if he adopted his former testimony.

Using an vague idiom like "stand by" obfuscates the entire endeavor. Intentionally, I imagine.

That’s a fair argument. Though I think a layman (juror) understands what he said. I don’t think tossing the indictment on that alone is proper. If there are other deficiencies then toss it. But that alone,to me, is not fatal.

Sure. I'm not speaking in absolutes and that would be a factual determination. I wouldn't think it would be likely you get 12 of them.

Oh I'm not arguing that.

And I argued that the other text issues in the indictment almost assuredly can be corrected via amendment. I just don't know what nucleus-relating standard they use.

Will be Interesting to see what happens. I remember Devlin bragging about getting something thrown out on procedure. And I recall thinking “man…what a bone head you must be to lose a case on procedure.” Happens all too often, though.

Still. Devlin is no Bockrath.
