Under the current law the judge can determine whether they have to register as a sex offender if it is vaginal penetration with a penis.
They’re adding anal to gay sex is brought under the same Discretion.
I personally Think 10 years is a pretty big age gap for a 14 -17 year old. Whether they are having but sex or not.
Louisiana I think it's 4 years for the misdemeanor offense.

I call it fundamental fairness, due process and equal protection (and application) of the law.
The ten-year element is indeed too great a difference in the vast majority of cases, and it should indeed be shortened, for BOTH heterosexual and homosexual offenders. That is a rather different question, and one would HOPE that you understood that.

So the argument on this is that all the bill does is make the gay laws equivalent to the straight laws.
Which should be acknowledged to have a fair discussion.

As the law NOW stands, AFTER a conviction, a judge has the DISCRETION to decide whether a heterosexual offender will be placed on the offender list for life. The same judge does NOT have the same discretion for a same-sex offender. He is MANDATED to place THAT offender on the registry for life.
The bill simply gives the judge EXACTLY the same discretion in both cases.
EXAMPLE: 23yo has consensual sex with 17yo, but parents press charges and 23yo is convicted of sex with a minor. If the participants were of opposite sexes, the judge has the discretion to decide whether the 23yo spends his entire life on the Registry. If the two participants were the same sex, the judge has NO such discretion. Lifetime Registry.
This bill simply says that the judge should have the same discretion in both cases.
