That's the argument at least.


I can agree the administration made their own problem here by simply not stating why the change was made (re: APA), but there's also an argument to be made that this falls within the exclusionary area of 5 U.S.C. § 553(b)(B) ( LINK)

What they are doing is arresting people for being here illegally. My guess is the government is going to argue that posting the policy change would be contrary to the public interest of enforcing immigration policy by alerting those here illegally that they could be arrested at the courthouse.

So, the federal government can't carry out the law unless they properly document a reason for carrying out the law.

DOJ will win on appeal. Meanwhile, Trump will find a workaraound. One of the best builders in the world like him knows how to get shite done.

I’d suggest to DJT that ICE simply revokes the policy, but ICE agents are given general advice to faithfully execute the statute anywhere they can lawfully be present. Not a snowball’s chance in hell ICE agents can be banned from a public courthouse.

Also the class actions rather than universal injunctions games is silly. The black Justice wrote in her dissent that it was a viable alternative.

*ETA: it was created by Congress to rein in leftist abuse of Executive agencies (primarily FDR in the New Deal), which Congress can do since the only reason the Executive has these particular powers is because Congress authorized it.
