Yea i read the statute. They were not in the presence during the crime And did not have immediate knowledge of it according to what they told police at the time. According to their own description he just saw someone running down the street, and planned to confront him because there were break ins over the past few weeks. Citizens arrest requirements were not met.

it’s going to hinge on when that “confrontation “ is defined.

If the “confrontation” is him charging them, they walk.

If prosecution argues they should have never been there with weapons to make an arrest and that is the “confrontation”, they’re murderers.

Hence my original assertion.

It's readily obvious that "in person" isn't required based on that language.

You can say it’s reasonable to assume he was up to no good. I think that’s appropriate and fits into the “real world” and not PC mumbo jumbo.

But, none of that is justification for a citizens arrest. So even if the McMichaels saw him coming out of the house, they don’t have immediate knowledge of a felony. And they didn’t see that. So they still don’t have a justification of a citizen’s arrest.

So from all indications, even the crime that the person who made the phone call (who witnessed the activity) and reported to the folks who attempted to detain him, would be (according to the person who actually witnessed what was going on) ... misdemeanor trespassing?
