How many times have we seen, on videotape, an obviously armed black man walk toward police with a rifle across their chest and two police armored vehicles at least pass the guy walking down the middle of the road without 20 or so kicking the shite out of him? Technically entering the US at any point, seeking authorities and announcing you are seeking asylum is not only not illegal it is legal by US law and by international law.....doing the same thing and avoiding capture by the authorities is a low level misdemeanor....but if you committed that misdemeanor and it resulted in someone's death couldn't you also be charged in that death?

The cops knew who he was and knew he was not a threat to them. They had interacted earlier in the day.
That, of course, begs the question: why wasn't he arrested earlier in the day by the cops who met him? He had the rifle with him.

Just after he regains his feet he points the weapon into the crowd again. Does not shoot but brandishes it in the general direction of the crowd. It is un mistakeable...he is walking away, turns and points the gun at the crowd.

No, many cross the border and seek someone in a position of authority to tell them they are seeking asylum. Not an illegal act. If they try to avoid authorities you are correct, they have committed a misdemeanor at the same level as jay walking.
I am certain you are correct that is against the law to claim you are seeking asylum when you are not. That is a charge, however, that requires due process, not a judgement call on the spur of the moment.
