Man charged after fatally shooting suspect who allegedly tried to rob him in Queens: Police

Officials say the shooting happened in a driveway on 82nd Avenue in Kew Gardens at around 2 a.m. Wednesday.

The 32-year-old was armed with a sharp object and attempted to rob a 65-year-old of money and cigarettes, authorities said.

The 65-year-old, identified as Charles Foehner, pulled a sliver handgun and shot him as many as five times.

In surveillance video viewed by Eyewitness News, the assailant confronts Foehner from 40 feet. Foehner waves him off, raising his left hand, but the assailant continues to approach aggressively. With that, Foehner draws his gun from 20 feet. When the assailant waves an object and lunges, Foehner fires from 8 feet.


I will never be on a jury up there, but if I were: NOT guilty.

But you know they could release him without charges pending a grand jury investigation.

Incidentally, that is EXACTLY what is happening as to any potential charges from the shooting itself. He HAS NOT been charged, and apparently WILL NOT be charged, per the prosecutor's office.

He was arrested for POSSESSION of a firearm in violation of state law. He does not even claim that he legally owned the weapon, apparently.

Do you even understand that he HAS NOT been charged for the shooting?

Probably not. That would require reading. Or research.

The incident happened on Wednesday. He was promptly released on bail. He was arraigned on Friday, and he was NOT charged with homicide. In fact, the prosecutor said that he WILL NOT be charged with homicide.

It’s pretty asinine to charge someone with a weapons charge relating to an event where they were forced to justifiably defend themselves with said weapon.

But the political narrative is “guns are bad” so the politicians (which is what district attorney’s are) charged him.

Why?

I don't agree with NY law on ownership or possession of weapons, but it IS the law up there.

And this guy illegally owned this gun LONG before he used it to defend himself. That violation is independent of the shooting.

Damned right. That little girl was raped, and she should not be forced to carry to term the pregnancy that resulted from that rape. IMO, your opinion to the contrary makes you a zealot and a true monster.
