-Hospital screwed up by having a snake in there.
-Plaintiff over-reacted
-Hospital should (and probably did) treat the Plaintiff for her minor physical injuries (baind-aid ice on her boo-boo) at no cost.

If there have been previous injuries due to snakes AND the hospital has blown it off, then the hospital should be spanked.

If hospital has made honest effort at eradication, then hosp. shouldn't be spanked (it's friggin' Louisiana for cryin' out loud)

Otherwise, Plaintiff should get over it and frick off.

(BTW, I like my lawyers. Good and ethical guys who will actually reign me in at times).

this is the reason why illogical restrictions are placed on patients families. I would bet that family will no longer be allowed in preop area now.


I just don't get how everyone is excusing the fact that there was a snake in the surgery prep area. that isn't some kind of health code violation?

First off, the surgery prep area isn't some magical area. Snakes just get places. Probably in some storage area somewhere he found a nice cozy place to lay up and got wheeled into the area.

Second, I just file it into the shite happens file.

sitting in the room with a patient several years ago as she is pulling her meds out of her rucksack sized purse, I watched a 2 ft Texas rat snake calmly climb out of her purse and crawl over to the corner. She never saw it. I finished the visit, and clamly caught the snake and let it free outdoors.

shite happens.

Sure hospitals should not have vermin. And there should be measures in place to prent them. In the words of Forrest Gump though "shite happens". That being said there was no malcious intent here. Should people start seeing their docs and claiming phobias of things so they can run into walls and sue people when they unexpectedly see them? What about spiders? wasps? ants? clowns? white coats?

The lady was injured because she ran into a wall/door.

I lol.

I am busting through the door at my next sighting of anything out of place in Drs office. Mine has a picture of him and some white perch. I seem to be allergic to them anyway

What if it had bit the lady? Still "shite happens" and no one should be responsible?

If there had never been one there before, yes. Same if a wasp had flown in and stung her.

You are correct. The snakes really need to learn to read the no snakes sign.

Look, does the hospital take reasonable steps to reduce vermin in their place is the question...I would imagine yes, DHH, JCAHO, and other regs mandate pest control services. They must be reviewed at QI meetings, actions must be taken..etc.


I don't think the lady is suing because she was bitten, she is suing cause she went nuts. They should have videoed it and won a home video award...not sued someone.


Reasonable folks do not think to look under a surgical drape for a snake.

Things the hospital is responsible for...removing surgical sponges, not frying you when xraying you, making certain the Dr at their facility is actually qualified.

Hiring a pest control company, yes. Making certain that ZERO pests while all the while allowing air to circulate...not reasonable.


If this is the 10th snake, yes, it must be addressed. But I don't know that.

I'll wager a pitcher of beer that this was a rat snake. They get into all sorts of interesting areas following rodents, and Alexandria is notorius for its urban rodent population. Suit was just filed, so no answer yet, but you can bet that I am going to call the defense lawyer to find out what sort of snake it was. 80% chance it was a harmless rat snake. Any takers? Pitcher of beer to the one who IDs it first.

Who is excusing and what would a health code violation have to do with whether or not the hospital is liable for damages in this case? Is the species of animal important to you? What if it were a red-eared turtle(slider)?
