Ok I bought a rifle for a close family member,he is allowed to have it,not like he is illegal or anything. I also let him borrow a Marlin Model 60 stainless that I had,but made it clear, hat that one is still mine,it's a loaner. He's had some troubles in the past.
I found out that he has not become as reliable as I thought, I called him out on it( he was living in my house, and I told him that he had to leave). He left, but took both rifles. Stolen/not stolen? I have reported both stolen, because now I am afraid what will happen with them. To be clear, I would drop all charges,if he would return the model 60,and legally transfer the other out of my name.
Stealing a gun is a felony,I don't want to frick somebody like that without some serious shite, but I have to protect myself too. Did I go too far?

You didn't to too far, but are you positive he's able to own a firearm? If not, you coukd be in a world of shite.

Also, they aren't in your name.

I would give him a heads up that you reported them stolen. It might help to get them back.

It's not "in your name" in the first place. How do people still not understand this?

So is a straw purchase. You committed a felony if you filled out a form 4473 and answered yes to the very first question when you bought the gun for him.

Text message to the individual. Clearly state that you are sure that its a misunderstanding but that its very important that you get your gun back and the other one properly transferred or you will have to escalate this 48 hours from now.

Guns do not have to be registered. I'm not sure what you are doing here. Gifts are ok just as long as he is not a felon. What state are you in?

You bought him a rifle so that is his rifle and not your rifle anymore.

You should have took your gun back before you kicked him out. I would have not reported it stolen unless that was your absolute last option and everything else failed or you thought he would use it to commit a crime.

He didn't steal them until after he was given the guns, no big deal. Also, I'm not sure how he can report a gun stolen that wasnt his to begin with...indian giver.

It's not in your name, until something happens with it,then it is traceable. When you legally buy a firearm, the store fills out a form telling where it went.
FFL dealers don't give serial numbers when asking if they can sell to you,but there is damn sure a record for change of ownership.

Link?

ETA: you can be tracked as the original buyer, but after that, it could be sold a hundred times with no trail.

Hate to tell you,but every weapon legally sold, the serial numbers have to be written on the transfer form.
It's not done on the computers, but there is still a record of the transfer.

Not true. Thousands of legal person to person sells happen every day and there are no forms.

As I mentioned, I am talking about sales through FFL dealers. Both rifles were purchased that way,all up and up.
As a matter of fact, neither were high dollar weapons,so I never wrote down serial numbers. When I decided to file charges, I went to the dealer,he gave me the serial numbers in a few seconds. On file on his computer.

This is false. A straw purchase happens anytime an actual purchaser gets someone else (straw purchaser) to complete the background check portion of the sale. It does not matter if the actual purchaser is a prohibited person or not. If you are buying a firearm as a gift for someone else that you know is not prohibited from taking possession of the firearm then that is OK and you would check Yes indicating you are the actual buyer/transferee.

That 1 was a gift, the other was not. I explained this to the police, they suggested I claim both stolen.

Exactly. He has never been convicted of a felony,or domestic violence.I know his history damn well. He can own guns.
