Be careful and take the good with the bad. This could lead to abolishing the law that a convicted felon cannot own a firearm, which would lead to more people to look at the 2nd amendment in a negative light.

I don't know the answer, but it seems to me if it were to be considered a fundamental right, then that would suggest any modification to that right must be looked at under strict scrutiny. Don't know if this would lead to convicted felons being able to carry guns.

I dont either, but sounds like a scare tactic by those opposed. Just checking.

Dumb as in it really doesn't change anything?

I thought we already had something like this in the LA constitution.

He means that federal law trumps state law, so this is mostly a moral victory. Not all that different from the states passing recreational marijuana legalization measures... the feds can come arrest anyone they want no matter what law the state passes.

No one can predict what a court will or won't do on this, so calling it a scare tactic because an answer can't be given is misguided.

Simply put, it a reasonable possibility that this amendment could allow convicted felons to possess firearms.

Actually, it doesn't but the fedgov has convinced the vast majority that it does. Per the constitution, the states have more power than the fedgov.

KG6,
My responses are based entirely on my personal research. I'm not a lawyer. I've not consulted w/ any lawyers. Like all the other responses here, you can take my personal thoughts w/ a grain of salt! :-)

quote:

Some argue that compared to present language (which currently protects gun rights), this adds in the possibility of "strict scrutiny" which opens the door for more gun control.

No.

quote:

Others argue that this will strengthen our state laws to keep our rights if an attempt to increase gun control takes place.

Yes.

Prior to this thread, I've not read that this Constitutional Amendment could potentially make it possible for a felon to own a gun. I've already voted, but would still be interested in seeing a link that references the actual pro/con arguement of this.

Most of my research came from here:

HAHA are you serious?

It is STILL ILLEGAL for anyone convicted of a felony to even possess a firearm. This amendment will not affect that.

And how do criminals get their hands on firearms anyway someone asks... They're CRIMINALS. They don't follow laws. How hard is that to understand? Where there is a black market there is illegal trade. Get your own firearm to defend yourself against them because that's all you can do.

And someone mentioned this would change carrying on college campuses... Unfortunately it won't.

I was actually interviewed over the summer by The Reveille on the phone about the amendment when it was proposed. There were so many whistle blowers and bleeding heart liberals who were saying it would make our campuses the Wild West. Besides the fact that I adamantly disagree with these ridiculous claims that should have already come to fruition in the 200+ colleges around the country that permit concealed carry already (for nearly 2 decades, mind you), this law will not change that.

Vote YES!!!!!!! It's the right thing to do.

And to the guy who is a district attorney... why would this make it harder to penalize criminals who are already criminals illegally possessing a firearm in the first place? Doesn't this strengthen the rights of law-abiding gun owners? I'm seriously curious and not being a dick.

Yes it sure does! hopefully this Amendment passes and other states will follow suit and get something similar if not exactly the same passed as well.

I'm voting ''Yes'' We the people need all the help we can get to insure our 2nd Amendment rights stay strong. This has nothing to do with thugs gun rights, because they don't give a crap about any laws in the first place. The more law abiding people packing guns, the better. The police can not protect you.
