. If the handgun is ever lost/stolen and then used in some sort of crime, it will be traced back to me by ATF. I will then have to fess up that Imgave it to my son who lives in another state. Both he and I will be subject to the 5k fine and jail time for taking a handgun across state lines without following proper federal laws.

Nope. The gun was stolen. YOU have nothing to do with it after that. Tell me how will they prove you let your son take it out of state. I can move out of state and take all my guns with me. I don't have to register anything.

OP give the gun to your son and frick everything else. That's it. End of discussion. Quit worrying about what ifs.

Kew,

I think you worded your question wrong. From my understanding you had already gifted him this handgun back when he lived with you in Louisiana. So when he comes to visit, he will only be picking up his handgun that you've been keeping a hold of.

Is that about right?

Yes, if you are the person the gun was transferred to from the original chain of mfg -> retail FFL, LEO is going to come knocking wanting to know how your disposed of it. its a matter of in that rare event this happens do you want to have to lie, take the consequence or just be able to tell the truth and be done with it?

Gun stolen. I don't have a serial number to identify it. Case closed. They can go frick themselves. If I don't commit a crime using a gun, then it doesn't matter if I gift it to a felon, sell it, throw it away, etc. I'm not liable for what someone else does.

i had a roommate back in the day that that legally sold a gun to someone. it was somehow or another used in a crime about a year later, iirc by another person than who he sold it to. my roommate actually had to go to court to testify. by all means you are welcome to do as you please, but i'm not sure its as easy as "gun was stolen, frick off".

And? It's not in my possession. I don't recall is a damn good excuse for politicians.

I'm moving to Arkansas in a couple of weeks with my firearms. My kids are in Louisiana. They will get my guns and it won't be through a damn FFL.

This has to be the dumbest thing I ever heard of. Wtf would I need to transfer my property to my kids with a fricking government agency? Because they said so? frick off ATF, FBI, IRS, CIA etc.

Not arguing with the dumbness of the law. If you move to Arkansas, you are free to take your handguns , but if you gift your son handguns in another state at a later date, you are in violation of Federal law
