Here are the steps.

- Make a machine gun.
- Get caught with it.
- Go to court.
- Use this case decision as precedent.
- Court dismissal will be your permission slip to continue ownership.

TBD until the Supreme Court addresses it.

If you make a machine gun but never fire it, is it a machine gun?

I think this more of a positive for those busted by the ATF under bullshite constructive possession charges. I don't think SCOTUS will take a case that cuts to the core of the NFA any time soon given they are slow walking AWB cases, think one that attacks the Hughes Amendment is a better path.

They've shown they're fine with restrictions on machine guns. There's well under 200k civilian transferable in country, and it seems like that would fall short of the common use standard set in Bruen.

Wrong…?

A report states that in 2021, the ATF announced that there are 741,000 legally registered machine guns in the country. Not sure if that includes/excludes SOT lowers for dealers that are post-1986.

Most aren't transferable, for the reason you addressed in the last sentence.

apparently, the judge in this case didn't care if they're transferable or not. he used the 740,000 number as a reference for the "dangerous and unusual" argument in Bruen.

in the decision, he says:

Seven hundred and forty is no small number.

that's good news for us i guess.

Did Bruen state they need to be transferrable?

Worst part of the stupid Luigi shite is the argument can easily be made that suppressors are common use items, and the political climate was very meh on them before that idiot.
