WWYD - Delivery Damage

Delivery company scratched wood floors in several places bringing in a new bed. Guy drug the box across the floor and the large brass staples used on heavy duty cardboard damaged the floors.

Here’s the details

- made a claim with delivery company
- got quotes and submitted to delivery company; feel good about the guy projected to do the work
- delivery company doesn’t like the cost
- says they will get their own quote
- their quote comes back 2K less; went off pictures and sent no one out to see damage
- delivery company saying they will not pay the amount in my quote as they found someone cheaper

WWYD?

I plan on going to their office tomorrow to discuss this. Is this worth taking it to a small claims court if they stand firm on not going with the person I chose to do the work?

Are they sanding & refinishing the whole floor?

You need to look into some Pergo, baw.
You can’t scratch that shite with baseball spikes.

Yeah, sanding and refinishing with stain and polyurethane. The floors are about 4 years old. Just worried about the color match as the polyurethane sets in over time. Don’t want to have a section off colored from the rest of the house. It happened in the living room too.

I mean small claims court fees be like 59 bucks so you may end up out more dollars in which I would say just put a rug over it bro.

A rugs not covering these man. Multiple scratches in different parts of house. Right inside the front door, in front of fireplace and leading into bedroom.

I was there when it happened. I was in the bedroom helping one of the delivery guys unpack the first part of the bed they brought in on a dolly.

The other guy had the headboard and decided he was going to be hero and bring it in by himself. it was too heavy for him to lift by himself so he drug it across the floor.

but really, just stick to your guns and proceed with having your guy do the repair.

if they continue to buck, get an attorney to sue for repairs/legal. costs.

Let them use their quote and their guy, but draw up an agreement that says when the work is finished the floor will be restored to the way it was before the damage. If their guy screws the pooch, then you can wring em in court for the damages and breach of contract.

That could be a viable option along with getting an attorney if needed.

The kicker in all of this is we plan on putting our house up for sale in a couple months. Couldn’t have happened at worse time.

this changes everything.

in a few months it literally won't be your problem.

I guarantee potential buyers wont notice subtle floor variations when doing walk throughs.

Even if they do, price the house higher by a couple thousand and "concede" that money in negotiations if they by some chance list it as a factor.

I’d like to just cut a deal with the delivery company to cut me a check for the damages at the quote I provided them. If the buyer wants the floors fixed and I’ll have them done. If not I’ll knock the amount of the quote off the sale price as they may want to do something else.

No. The floors need to be fixed. Even a half assed repair would be better than buyers walking in to see scratches in the floor. Personally, my thought would be "if they didn't fix the floors, what else have they neglected?".

So, if they want to send in their guy to get that done quickly, even if it isn't better than the guy you had picked out, run with it.

The juice isn't worth the squeeze to have it done "perfectly" in the grand scheme of things.

Had a similar thing happen. But RTG refused to pay at all. After several weeks of sending & resending photos of damages & other correspondence at their request, it was denied. They know how expensive & time consuming small claims court is.

We will never ever shop or buy there again. Worst customer service I have seen lately.
