They are required by law to report. The church's right only extends to the point at which others rights are being violated.

My wife is an elementary teacher. Duty to report. shite gets bad, quick, fast, and in a hurry if it becomes knows that she failed to report a situation once she was aware of it.

This has been covered already. Privileged communication trumps the duty to report (in Oregon).

The issue at hand is the Church says the communication was not privileged, the wife said it was.

If the conversation was privileged, ex. lawyer or priest, the privilege belongs to the person that made the statement. Even if the priest/lawyer makes public the previous crime, the information would still be inadmissible.
