I don't think so at least not generally. Specific intent can be formed in a fraction of a second. The moment you decide to lift the gun. It doesn't mean he plotted it or that he necessarily thought he'd do it thirty seconds before. So "stone cold" may apply to some specific personalities, but not for the majority.

Yeah I was basing it off the idea of going from manslaughter to murder 2 from the boiling of the blood to the cooling of the blood...

Yeah I'm wondering if prison is a viable weight loss regimen. I need to unload 25 or so lbs and not interested in putting the fork down.

I've seen it work either way. People lose weight and people gain weight. Being that big, I doubt he is getting the calories that he was getting on the outside, unless he is eating a bunch of junk food from the commissary like honey buns and shite. He isn't getting much exercise in opp that is for sure. Maybe can pump out some push ups or something but that's the extent of that.

Just looked it up and that is absolutely false. Hayes is the only person that has stated Smith said he was going to get a gun.

What McGaw said was this

He never said he heard Smith say this, only that Hayes stated it.

From what I was told (didn't quite understand the reasoning) is that this video wasnt admissible or something because it was actually filmed by someone in the media and they didn't tell the person they were filming initially or something...
