What is the normal timeframe for being out of work when dealing with LWCC?

Wife fell at work and has been out since May 1 and still nothing has been approved by them to let doctor do procedures needed.
Edit to add, this was a slip and fall back injury. No surgery just nerve burn and steroid shots.

What is the procedure? When was it reccomended?
Was it pre-certed?
Dre they requessting a seccond opinion before approval?

Just added it was a slip and fall back injury. Steroid injection, nerve burn. I was recommended about 3 months ago and second opinion was done before it was recommended.

Should be done by now. Call adjuster directly. If they aren’t cooperating get a lawyer.

Have they denied it or just not responded yet?
When was the second opinion? Did they agree with the treatment plan?

No response. Wife would continually try to call and leave messages but no responses. When they finally got in touch, the doctor that was supposed to do procedures needed was going to do it at said place and the day before, wife received email it would be done by different doctor and a different place. Didn’t feel comfortable doing it because doctor was not known or the doctor that was approved.

So, let’s think this through..if they get a lawyer, pay him $5,000 minimum just to start, what do they do in the meantime while they wait 5 years for him to get anything done? A lawyer can do no good except cost them money. Lowbrow simpletons think a lawyer is the answer to everything because you see commercials, billboards and watch Law & Order. It’s a knee jerk, reactive, non thinking response. They have no magic pill for instant results.
The better answer is, if it is really necessary, is to call the state insurance
board. The only people who win when lawyers get involved are the lawyers.

But really, there’s no reason she should be out of work for this. Nerve burn? Gimme a break. That’s a BS diagnosis. How much are you trying to get? Disability? Workmans comp? Who are you suing?

I deal with workers comp all the time as a provider. Sometimes if they aren’t doing anything at all you have to get a lawyer to get things done. No one is paying a workers comp attorney up front to get started. It’s not knee jerk when it’s been months with no response. Lol
Edited to add: OP, luckily LWCC is a local company and if you can’t get in touch with adjusters directly you can usually call the main office, which you can find the number online, and find out who their manager is and talk to them. If it’s just an unresponsive adjuster, that will usually get things rolling.

I take no offense to your shitty comment. You don’t know me and I don’t know you. Just know that this was a last resort because LWCC doesn’t allow you to return to work until you are released. The nerve burn is to help my wife, be able to return to work. Again you have no idea of what you are saying or what she is going thru. Never was about suing for money or getting a free paycheck. She just wants to return to work to take care of the people she cared for.

This is where things are crazy. The adjuster we were given first took care of what needed to be taken care of, then this other person is the one that was unresponsive. We contacted the main office and did what we were asked to do. The problem is we followed everything that we were supposed to then when deadlines were coming, nobody knew she hadn’t been through the procedure that was needed. Dates come and went and the follow up tells us wait another 6 weeks while no return calls from the adjuster. When we finally get in touch h with them, we are given the run around about different doctor from one that was approved, totally making it untrustworthy from a patient standpoint. shite just sucks all the way around. Lawyer has been contacted to try to get this shite figured out, so my wife can finally get relief. No money needed from lawsuits.

Um.... your wife gets her choice of physician by law. They absolutely cannot do this.

Don’t lawyers work on a contingency in these types of cases with no money down?
Lawyers that specialize in this field know your rights and know how to navigate the pitfalls of the workman’s comp system especially in Louisiana where there is pretty much only one game in town for businesses to get workman’s comp insurance.
The attorney gets paid by the insurance company for hours worked or a percentage of the case if you end up in court.
Which is why getting an attorney sometimes gets LWCC off its arse to get the case resolved knowing they are not only paying doctors and an employee, but they also are paying an attorney in the mix.

So they did approve the procedure. Who made the decision for a different doctor and facility? Was that someone in the doctor's office? You get to choose your doctor. The WC carrier cannot just select a doctor. Seems something is missing in this story.

LWCC changed her doctor and where procedure was to take place after doctor had already told my wife where and when procedure would take place. They called my wife the day before, after 3 weeks, after she confirmed with them, what doctor said, that they were changing the when, where and by whom.

Yes and it's capped at 20%. As a lawyer that handles WC cases, that guy doesn't know what he's talking about.
Not legal advice but my gut says your COP ordered the injection(s) and it was to be performed by a different pain management doc that your COP works with
You also claim it wasn't approved but then say it was approved, you just refused it. Talk to a lawyer

The vast majority of attorneys out there will have your wife in unnecessary surgeries and treatments to drive up the bill, using her as a human money printer. IF you need an attorney find one that does not run these WC mills. Basically if they say they specialize in WC stay as far away as possible. Unless of course your looking to change out that wife for a new model.
WC is statutory. Laws and process are clearly defined. A WC “expert” is not a thing because its truly the simplest process out there. Be careful and i hope she gets treatment soon

A probate attorney can navigate WC. The rules are all quite literally written into the law. There is no gray area, there is no flexibility. It is simply procedural.
The single incentive for the attorney is driving up medical bills to increase their take. WC mills NEED the claimant to continue treating as long as possible and the bigger the surgery the better. A claimant returning to work quickly is of zero value.
So say what you want but 100% the dept of insurance will push the issue for this person for free.
