I should be a lawyer. I just thought of a perfect legal defense in a criminal charge. It wouldn’t work in a civil case but it definitely would throw enough doubt on the charge to dismiss the charge.
We know his wife was in the bathroom. Just say he thought it was his wife walking by. Stick to that story, no matter how unlikely.

The laws likely written for a wide range of offenses. Up to a year gives a wide range of punishments (including no jail)

A man with half a brain and one leg knows that it is not sexual assault.

It seems that people are scoffing at the notion that slapping some woman they don’t know on the rear end shoudnt be considered assault. Kinda like, “Yeah, it shouldn’t happen but NBD”.
Keep your hands to yourself and you won’t have to worry about the legal ramifications of not keeping your hands to yourself.
