Whataboutism has no legal teeth. Wayte v. US allows for selective enforcement unless it contravenes case law like the racially biased enforcement outlined in Yick Wo v. Hopkins, or the law is racially biased on its face.
All I am doing is countering the idea the actions of the Canadian protestors (as I understand them) would be protected via the 1A in the US. If someone can articulate an argument based on the law I would actually like to hear it.
