you can't scan notes from a class you are taught. if it was the LAW, then you could CITE the law.

I cannot argue with you on that point. I cannot remember if it was in note form or in a textbook that would have gone into one of my notebooks. I have numerous notebooks so I am not exactly excited about browsing through all of them. I will ask around and see if we have anything written that has no insignia on the top.

thanks. i was taught that you can't be charged for having a weapon on you in a car, but once outside its illegal carrying. makes sense, but not in the law. neither is concealed carry in my home

If any regular citizen would've done what he did, they would've been charged with the felony.

This Internal Affairs investigation is just to save face. The man pushed a cop. He should be charged accordingly.

I'm not even going to get into the ridiculous jurisdiction argument that you have made, but can we discuss the above for a brief moment?

Dan, what department do you work for, (since you seem to be up to date on the LEO jurisdiction laws of the state of Louisiana, I am going to assume its a L.E department in this state), and what criminal code do you guys follow where the battery on a police officer, (that doesnt result in an injury), is a felony?

Can you please link that particular statute number?

It is an enumerated offense. I have honestly never written it alone. The fewtimes I have written it it has accompanied another offense making that offense a felony.

State sire marshal's, and the arson investigators they employ have the ability to make arrests ONLY for violations of RS 14 and RS 22 codes, in other words arson and insurance fraud codes.

Your above statement is like saying an LDWF agent can only make arrests for wildlife and fisheries violations.

Wlf agents have state jurisdiction for all misdemeanors and felony offenses. They can also enforce many federal wildlife laws.

In my experience

Huval was summoned either because BRPD screwed up and wasn't justified in tasing him.

Or

The state police requested he be released on a summons and will conduct an administrative investigation that could result in suspension without pay from 1 day to 6 months or termination.

And even though it seems getting summoned is preferential treatment just remember when a normal citizen gets arrested for a misdemeanor the police don't call your employer and begin administrative proceedings against you... so it kinda evens itself out.
