It was a very fuzzy situation. The Trooper still has jurisdiction, even though he is off duty. The summons means he still has to appear in court to answer for the charges. I think that was probably the best thing to do in that situation even though many will disagree with me.

I have a 100 mile electric fence transmitter on 300 feet of wire outvback. Id rather lick a wire than hold two prongs of a taser again....noooooo thank you.

So why didnt the trooper go to jail? The dept I used to qwork at had a policy that if you used force to subdue a person it was followed with an arrest (an actual one, not a summons in lieu of arrest).

Every department policy is different. I have no idea what BRPD policy is. It is also called arrest via summons.

The fact that he got a Summons is significant. You guys should only be bitching if he was allowed to walk without being arrested. As far as not booking him, the people who pointed out that he is not a flight risk and not an immediate danger to the public thus making him an accepatble Summons candidate are correct.
While many will not like this answer, here is a fact, it is a huge pain in the arse to book a law enforcement officer/officer of the court/celebrity/etc. For obvious reasons, they have to clear a cell and keep the person segregated. If the Jail is busy (as it may have been on a weekend night) this makes the Summons route a good option in those cases.

not true at all. from 1996-2011 99% of misdemeanors were not booked.

So why not release the brother on a summons then? Him being the trooper's brother one can deduce that he isnt a flight risk either.

Yeah I wish I could not do my job sometimes b/c its a "huge pain." I wonder how my boss would take top that. Problem number one with govt. jobs in general

Feel bad for all the BRPD guys that I see speeding all the time in Livingston and Ascension in their cop cars. Something tells me State Popo gonna drop a nuclear bomb on some BRPD guys.

That is nonsense and you know it. If Huval did not show up he would have a bench warrant issued and would lose his job. Does his brother have the same amount on the line. You are just trying to be contrary.

It would cost the taxpayers more to lock him up. I issue summons quite often instead of taking people to jail. I find it hard to believe that you ever worked as a cop.

I can tell you that he was not charged with battery of a police officer because that is a felony and he would have been hooked. I imagine this scenario is not as cut and dry as it appears.

Scruffy bets there are just multitudes of times you gave someone a summons for what every cop would classify as assault.
