In jurisdictions that require a specific prayer, you are almost always going to see that. Just like if you are a passenger in a car that was not found to be at fault the driver will almost always be sued along with the at fault driver, though in some areas cops don't make a fault decision like they used to.

Speaking of setting a hard cap on your damages early on, two FTCA claims found their way on to my desk recently

But it’s very clear you are not going to do this:

Wrong. You would get ZERO. The insurance company would deny your claim and you would get $0.00. Now you get to go against their lawyers all by yourself and have no clue what to do and they will frick you over.

They aren’t going to clean her out. If she only had minimum liability coverage, she doesn’t have anything to give. Can’t squeeze blood from a rock.

Your BIL will get policy limits, whatever his own coverage provides on top of that, and that’s it.

You seem so sure. So he's going to get her $80k coverage limit, give 40% to the lawyer, and still have another $100k in expenses, and you don't think the lawyer is going after that?

I think he’s got something for me from the Poli Board but I didn’t expect him to be this transparently dumb and hostile to everyone else

No, I don’t. Why would he?

There is practically no chance of ever recovering a dime of it.

As others have said, you aren’t getting her house or retirement. She’s got two kids so you aren’t getting anything remotely tied to them as far as investments like a 529. And the excess judgment is dischargeable in bankruptcy, where he will be at the bottom of the pile behind her secured debt and (most likely) credit card debt.

Your BIL is fricked and so are you if you’re supporting or providing for him. There is no big check coming.

The nice lady who hit your BIL is on the hook for $500k in damages. Her insurance company contractually obligated itself to pay up to $15k on her behalf. How do you get the $485k from her? Take the judgment. She files bankruptcy, your BIL is a creditor along with whomever else, he gets next to nothing.401(k) is exempt from seizure, so is the homestead for the most part.

What happens if you’re the lady with the 15k min coverage but you actually have 3 mil in liquid assets in this scenario?

We know, I guarantee everyone participating in this thread has solid liability limits, an umbrella, and UM/UIM at the max based on their liability limits. Good advice and nobody is arguing that.

You keep referencing your BIL's potential recovery, so people keep countering with reality. Accept that reality and you can go on about your PSA to have resonable limits on your insurance coverage unabated.
