In jurisdictions that require a specific prayer, you are almost always going to see that. Just like if you are a passenger in a car that was not found to be at fault the driver will almost always be sued along with the at fault driver, though in some areas cops don't make a fault decision like they used to.

Wrong. You would get ZERO. The insurance company would deny your claim and you would get $0.00. Now you get to go against their lawyers all by yourself and have no clue what to do and they will frick you over.

They aren’t going to clean her out. If she only had minimum liability coverage, she doesn’t have anything to give. Can’t squeeze blood from a rock.
Your BIL will get policy limits, whatever his own coverage provides on top of that, and that’s it.

You seem so sure. So he's going to get her $80k coverage limit, give 40% to the lawyer, and still have another $100k in expenses, and you don't think the lawyer is going after that?

No, I don’t. Why would he?
There is practically no chance of ever recovering a dime of it.
As others have said, you aren’t getting her house or retirement. She’s got two kids so you aren’t getting anything remotely tied to them as far as investments like a 529. And the excess judgment is dischargeable in bankruptcy, where he will be at the bottom of the pile behind her secured debt and (most likely) credit card debt.
Your BIL is fricked and so are you if you’re supporting or providing for him. There is no big check coming.

We know, I guarantee everyone participating in this thread has solid liability limits, an umbrella, and UM/UIM at the max based on their liability limits. Good advice and nobody is arguing that.
