So if a group of kids has a party, and one of them ODs in a tub, ALL can be charged with his death.

But you can sit back and actively film a death, not even calling the cops, and not even a slap of the wrist charge?

I was mostly deriding the inequities between the two situations, but yes.

And you mock, but in a fifth of states it's actually law. If you are sitting back and watching a hazardous situation you have a legal obligation to either:

1) attempt rescue, under civil protections if you cause harm in the best of intentions

2) Call 911

Not crack jokes, and have so little regard to the lives involved as to put post it on social media.

Good Samaritan laws do not really involve duty to rescue.

They just protect the actor from civil and criminal liabilities.

I think it is likely they had something to do with this guy entering the water in the first place. They probably saw he was disabled and told him to swim from one side of the lake to the other and they would share their weed with him.
