As another poster said prior, a violation of a person's Constutional rights is far different than a procedural technicality. But you go ahead and talk out of your arse. Oh yeah, you might want to get a Black's law dictionary and read the definition of causation. I suggest you take your own advice and let it sink in before you post.

Very unlikely for DA to go for 1st degree, even if facts fit. They hate it bc it makes the case much harder, and there is no particular advantage.
Murder 2 is life with no parole. Murder 1 can bring in death penalty but unless it’s Derek Todd Lee it’s not gonna happen anyway.
