In the case of the Dr I tend to agree, there’s an argument to be made.

In this situation the captain of the boat still shared responsibility for allowing the kids to do something that stupid, and his impairment probably contributed due to his reaction time being altered. I don’t have a problem with the charges in this case, the basic facts are a disaster waiting to happen.

We have this stupid tendency to widen the net instead of increasing the punishment, and it has resulted in some very low blood alcohol levels being considered over the limit. Instead, we should have kept the levels higher and radically increased the punishment. How about one year in jail for the first offense and five for the second? But only if they are actually intoxicated.

If someone falls off the front of the boat while running then reaction time sober isn't going to help you. If someone survives that situation it's by sheer luck.

On step absolutely, if just putt puttin around there’s time to throw it in neutral and start tilting up, pontoons do a lot of that, so just depends on what was actually going on when the accident occurred. Regardless, if I see somebody falling into the water I’m putting in neutral immediately, just to have a chance of not hitting a spinning prop at 3-5 thousand rpm’s.

Even if they were why were passengers on the front of the boat?

This fatality occurred due to a series of disastrous choices by an individual who had no business handling a boat on the water on any day, much less the 4th of July Holiday.

The number of posters in this thread rationalizing drinking and operating a boat is pretty amazing, it is not going to stop without severe ramifications if caught.

Nothing to think about, it doesn’t say and I have no idea, which is why I mentioned both scenarios, but doesn’t really matter, in either scenario impairment could have been a factor in how he handled it, not just the reaction to the girl falling in, how he handled the boat leading up to it.

That was my thought as well. I doubt the guy knew to immediately get it in neutral.

The drunk guy driving the boat is like the pilot of an aircraft - he's in charge and is responsible for the safety and well-being of his passengers. He failed this girl and will be held accountable.

Similar thing happened to a high school classmate of mine about 30 years ago.

Tragic. He was celebrating his young son’s birthday, who was in the boat with him. Just awful.
