Good question. Suppose the wreck would have involved another car that resulted in deaths. Does one still think he shouldn't be held accountable? How do you differentiate justice between family and strangers.

Plus some aren't considering that driver is responsible for those not wearing seat belts. He could be charged with 5 counts of involuntary manslaughter if they want money.

First the parents are to blame the kid should not have been driving at night.
Another thought i had about this is.
An 05 tahoe doesn't have 3 rows so some of these people were riding in the cargo area DUMB DUMB DUMB. Also it could have bucket seats in the middle row so there is less seats again. It is very sad that this family is lost because of someone not taking responceabilty and making sure evetyone was buckled on like there suposed to be.

another example, both writing the ticket and some of the responses here, of now completely screwed up our 'law enforcement' mentality is....

well if we were to imprison him then it would cost the state money. so instead of collecting revenue like they would with a ticket they would be spending money.

I don't think there is any justice here. Authorities can certainly make things worse though.

I didn't read through to see if it's been posted, but this is about determining the root cause, insurance claims, future law suits, etc. It's very sad, yes, but very common in cases like this. It's not like he was charged with vehicular negligent homicide.

LEO could call the insurance company and explain the situation. It's not like there is a dispute over who was at fault. There was one vehicle involved. Reguardless, the insurance company will pay out either way, if they had full coverage. Compassion goes a long way and the public would in no way frown apon a child that didn't get a ticket. Now, you have people frowning. Poorly handled in my book.

Sad but how do you sleep with a 16 yo behind the wheel? I wouldn't trust a 16 yo with my matchbox car much less my real car...and the life of my family.

I know it's just a ticket but damn really? Kid just lost his family that he accidentally caused.
