Meh, it doesn't really work that way in practice. Every other state requires unanimous juries, and it can work both ways.

I believe Oregon also convicted on a 10-2 count as well. Only 2 states if I remember right.

Smith was a drunk a-hole, but Hayes admitted that he got out of his vehicle with his gun in hand after running into the back of Smith's car (most likely because he was pissed off) and he never said that Smith threatened to kill him. He said that Smith said "I'm going to get my gun" as Smith was standing there with his gun. Was Smith not allowed to have his gun for possible self-defense since Hayes had his gun?

Hayes then said on the stand that Smith punched him, then said he thought Smith shot at him first and then he said he didn't shoot Smith's wife in the leg. He just wasn't credible and no one backed up his story (not even his friend riding with him). He lost control and shot Smith in the back 7 times. He went to the slammer for good reasons.

I don’t know too much about the shooting but

Relatively well known Will had a mistress in town. Who is a lot less attractive than the widow. People are crazy. A wife that hot and have to have some 6/10 poon. I guess what they say is true - show me a beautiful woman and there is probably a dude that’s tired of fricking her

Also the whole bonding out of jail thing after the dragging by hair incident

I can’t remember was this Blanket across country or when state moves away from unanimous juries when cases still going through appeals.

If blanket Did the Supreme Oligarchy point out why this specific verbiage wasn’t always considered a constitutional requirement or when an amendment added this verbiage to constitution?

Case has some interesting side stories, wonder if they will be revisited.

Drew Brees attended the original trial in support of the widow, which in this case could have helped sway public opinion against the black defendant, Cardell Hayes, whose conviction has now been deemed unsupportable by law.

Every other state is not Louisiana, possibly the most violent crime and murder plagued state per capita in the country... and every city is not New Orleans, with its "40 year low" of murders in 2019 that still put it among the 5 cities with the highest murder rates in the U.S..

Only about 1/3 or murders in New Orleans, as of 2019, resulted in an arrest. Probably significantly fewer than that for 2020. Unanimous jury verdicts is only going to make things worse.

He actually didn't claim this at trial, because it was so ridiculous. State put on the PI who the defense bpaid to spread that manufactured rumor, as well as the NOPD reserve officer they falsely accused of doing it, to dismantle it in front of the jury.

He shot a person 7 times in the back while advancing, the final shot so close that the shell casing ejected into the vehicle Will Smith was slumped into. Not a single shot into the front of his torso.

When Hayes got out of his car holding a handgun, should Will Smith not have the opportunity to attempt put himself on equal footing with Hayes?
