Speeding Ticket

Got one doing 32 in a 20. Didn't question it my mind was a hundred miles away. He came from aways back and I didn't even see him when I was caught on radar.. I grew to be respectful of the law even if I thought I was right. The officer gave me the ticket and asked if I wanted to see the radar and I said no sir. Here's the kicker. The street he shows me speeding is not the street I was ticketed for. It was blocks away and I was no where near that street.
Question 1: Does the radar show the actual street of violation?
Question 2: Does the street address of the ticket matter?
Question 3: Should I fight this?

Can you prove what street you were on at that time? If so, science tells us you can’t be in 2 places at once. A decent lawyer and a couple of competent physicists and you should be able to get it thrown out.

Not completely the same, but I had a cop wrote for for 31 in a 20 on street that actually was 30. I did not realize that at the time, so I had nothing to say while he wrote me teh ticket. Went to court and had to show proof, but it was dismissed.
Were you actually speeding? I'd just go 894 and be done with it if so. But you could likely get it thrown out if the info on the ticket doesn't match where you actually were. It's easier with a lawyer though

huh?

Yes it does. Can you get a judge to have reasonable doubt that you weren't on that road and that you were not speeding?

Question 3: Should I fight this?
Depends on the amount of the ticket and the value of your time

So you were speeding but he put down the wrong street.
Just pay the ticket and make sure you ask if he wants a blowie next time.

Yes, I can prove it. Just wondering if the radar goes off in his cruiser, does the radar at that time show the city, street and speed? Not sure if got somebody else and they got away so he picked me out just to bury his tracks. The chance I have the same color truck is pretty remote, but could happen.

quote:Well he said he smelled alcohol on my breath, which I really doubt. He told me he would take me down to the sheriff's office for a breath test and would be happy to do it. I said I had a beer before I left the house and was going to pick up Mexican food. I said if you think I'm drunk, let's go to the sheriff's office. I wait for him to decide what he wants to do, and when he comes back with the ticket, he tells me he's not going to take me to the sheriff's office, but I had to call someone to pick me up, I wasn't driving anymore. I call my son in law, and he picks me up and his son drives my truck home. They both witnessed where my truck was, and it was blocks from where the ticket states. And before I got the ticket, dropped by and checked on a disabled friend of mine and his street and the actual street I was ticketed on where different than what was written down on the ticket.

I don't believe my BAC was even close to being DWI, and I told him lets go to the sheriff's office if he thinks I am. I wasn't flipping a coin, I believe I know if I'm driving drunk or not, especially after one beer.

It was more that you had a beer right before getting in the car and don't think a cop could smell that. Either get a lawyer to deal with this or 894 it. I don't see it ending well if you try to argue it yourself.

Step 1: Buy a dashcam
Step 2: Defend yourself from this if you weren't speeding or where they say you were.
Step 3: Laugh at em in court.

I always do whatever possible to make sure that ticket is not on my record.
I'd call the number on the back. In some parishes they'll knock the ticket down to a seatbelt violation or won't put it on your record if you pay it. They just want your money. Is it worth missing work or altering your schedule for a $200 fine?
I will say it is quite enjoyable going to court and watching everyone give their excuses to the judge. The judge doesn't give a shite

[quote] everyone give their excuses to the judge. The judge doesn't give a shite[/quoteI I'm not giving excuses, if I was speeding so be it. But to get pulled over and get a ticket for another location just gives me the wtf mindset.

No, it only shows speed of vehicle vs speed limit set.

Thank you, I'll take this under advisement. But why not? He could shoot someone two streets over and then stop somebody else that wasn't even doing wrong.

It’s direct line of “sight” for a set distance and has to be calibrated daily.

Time is money... if you have it to spare for the gain then go ahead. if not pay it and move on.
