It's really not obvious, given the guy's internet history.

He needs jail for intentionally diverting police on the same day large, hostile groups from out of town showed up to protest across town. That was pretty clear judging by his subsequent posts bragging about it. He's too much of a narcissist not to shoot himself in the balls.

May meet the public issue requirement in this case but for 99% of cases, the statute is strictly limited.

City even noted Trump’s tweet labeling Antifa a terrorist organization preceding this guy’s original post. I think he’ll clearly meet public issue threshold.

And if he loses 971 motion to strike, he can get into discovery regarding the costs to the City. It’ll likely be above $75k and he needs to remove to federal court Immediately

Do you not remember Antifa being federally designated terrorist organization? That alone makes it something that had to be looked into. Also, a crowd of "protesters" had gathered at the mall a week earlier, causing police to close it and disperse the crowd.

He was also pissed at someone for spilling the beans about 1000 people being bused in from Atlanta. He knew a large group was going there, and he'd expected no one to see it coming, so he created the event across town at a credible place where rioters had gathered before in an effort to draw a lot of police away from the "real" riots.

Which, again, he expected to overwhelm unprepared police and others because no one was supposed to know they were coming.

So yeah, dude needs jail.
