Weren't they ultimately convicted of arson?
eta: And not that the Hammond's organized the current protest, but if they don't want their fight / cause / dispute to be linked to terrorist action it's probably not a good idea to have a group of armed men seize a federal building (regardless of its function or location).

Here's the actual court transcript from the original sentencing... this is the judge (Hogan) speaking:

I am not supposed to use the word "fairness" in criminal law. I know that I had a criminal law professor a long time ago yell at me for doing that. And I don't do that. But this -- it would be a sentence which would shock the conscience to me.

Interesting, I'm not sure if we're pulling from the same NPR article that I just came across because it has the same quotations.
Not saying I agree or disagree, but the Judge's opinion of the appellate court was interesting.
It appears that the Judge's harped more on the issue of arson than terrorism. I never followed the case, so I don't know why arson wasn't originally pursued, especially since they seemed to get a punishment that was similar to that of arson (according to Murphy)
