In 2011, 5 years after the police report was taken, the U.S. Attorney Office accused Dwight and Steven Hammond of completely different charges, they accused them of being “Terrorist” under the Federal Antiterrorism Effective Death Penalty Act of 1996. This act carries a minimum sentence of five years in prison and a maximum sentence of death.

Can you send me the link where you got that from?

I don't mean that in a snarky way, genuinely interested.

Weren't they ultimately convicted of arson?

eta: And not that the Hammond's organized the current protest, but if they don't want their fight / cause / dispute to be linked to terrorist action it's probably not a good idea to have a group of armed men seize a federal building (regardless of its function or location).

Here's the actual court transcript from the original sentencing... this is the judge (Hogan) speaking:

quote:

I am not going to apply the mandatory minimum and because, to me, to do so under the Eighth Amendment would result in a sentence which is grossly disproportionate to the severity of the offenses here.

And with regard to the Antiterrorism and Effective Death Penalty Act of 1996, this sort of conduct could not have been conduct intended under that statute.

When you say, you know, what if you burn sagebrush in the suburbs of Los Angeles where there are houses up those ravines? Might apply. Out in the wilderness here, I don't think that's what the Congress intended. And in addition, it just would not be -- would not meet any idea I have of justice, proportionality. I am not supposed to use the word "fairness" in criminal law. I know that I had a criminal law professor a long time ago yell at me for doing that. And I don't do that. But this -- it would be a sentence which would shock the conscience to me.

Interesting, I'm not sure if we're pulling from the same NPR article that I just came across because it has the same quotations.

Not saying I agree or disagree, but the Judge's opinion of the appellate court was interesting.

quote:

At the time, Hogan sentenced Dwight Hammond Jr. to three months of prison, and Steven Hammond to a year and one day. The federal government wanted the full five years, appealing the shorter sentences and eventually winning that appeal in 2014.

"Even a fire in a remote area has the potential to spread to more populated areas, threaten local property and residents, or endanger the firefighters called to battle the blaze," District Judge Stephen J. Murphy wrote in the appellate court's opinion. "Given the seriousness of arson, a five-year sentence is not grossly disproportionate to the offense."

It appears that the Judge's harped more on the issue of arson than terrorism. I never followed the case, so I don't know why arson wasn't originally pursued, especially since they seemed to get a punishment that was similar to that of arson (according to Murphy)

I pulled the quote from the court transcript: LINK

The entire thing just stinks. BLM has been trying for years to run them off and now they're manipulating the justice system to achieve their end goal. It's sickening.

I wonder if YallQaeada will be a popular baby name next year. It looks like something that would be on a resume at Mcdonalds in the future.

More from the transcript about the use of the Antiterrorism and Effective Death Penalty Act of 1996

quote:

THE COURT: I do have this question: We had
4 argument on it, but is -- what indication, if any, do you
5 have more than I have that when this five-year mandatory
6 minimum was put in in the Terrorism Act that this sort of
7 activity is what was anticipated? Is there anything?
8 MR. MATASAR: I can only say, Your Honor, that my
9 understanding, from what I included in the memo, was that,
10 you know, this statute is about through fire or explosives.
11 I think the focus of the statute seemed to be the explosive
12 part, the intentional aspect of it. I indicated all the
13 other sections here, they talk about foreign nationals, they
14 talk about terrorism this and terrorism there. But I see no
15 indication that this -- that this kind of activity was
16 intended in that statute.
17 MR. BLACKMAN: And Your Honor, I think the most
18 significant, if you are looking, really, at the legislation,
19 the most significant indication of that is in the definition
20 of federal crime of terrorism, which explicitly does not
21 include the 844(f)(1).
22 THE COURT: I read that in the memo.
23 MR. BLACKMAN: So I mean, it does strike us as one
24 of those legislative -- I mean, it's a huge bill. Sometimes
25 I think the Congress does things that it's not intended, and
1 the best indication that that's not what they intended is
2 that.

Since then, they've been convicted terrorist, served time, re-sentenced, & reported today to serve another 4+ years for the same crime. That's why people are upset.

Two questions:

1. Were the backfires warranted aka have Fire Experts chimed in on their actions?

2. Has anyone ever been re-sentenced like this?
