That's pure speculation.

I'm quite confident that more info will come out that hasn't been made available to the public yet. Now whether that info helps or hurts your opinion is to be determined.

If you get rear ended while driving you're most likely going to be the first one getting out of the vehicle wondering what the frick the other driver was doing. I believe Smith did that while Hayes stood at his door. Smith turns back into his front seat and Hayes comes up behind him and fires. IMO

We have no idea if that is what happened. Sure that's possible, but we have no facts or witness statements to back that up.

What if Smith was Bsing, and really didn't have a gun and was only reaching for his Phone? Btw, I don't believe this. Point is you can't just shoot someone because you think he MIGHT have a gun, you better be damn sure.

I'd say that is most likely what happened, but if Smith made certain threatening comments immediately prior to turning around, Hayes could and likely will make the argument that he only drew and fired after fearing for his life.

(I also am pretty sure this thread has gone back and forth arguing about the potential above scenario for 30 pages or so)

OK Sherlock. Let's hear your version of events. Did Hates or did Hates not run into the back of Smith's SUV on purpose? Did jailforlife or did not jailforlife have a loaded 45 on him?
