I have said all along i wouldnt be surprised if the worst Hayes gets is manslaughter in this. There are many facts we dont know, but as the story is changing daily.. it seems like smith wasnt just innocent victim. Did he deserve to die? Absolutely not.. but as facts are slowly comming out its looking more and more like smiths actions played a role in his own death. Im still saying manslaughter at worst.

Hence the reason I didn't say "reach for a gun".

It also says he was slumped over the steering wheel. that tells me he was already seated in his vehicle, so just getting back into it is out. That tells me he was reaching for something in the glove box or center console.

I'd bet Hayes approached the vehicle when Smith got back in to continue the argument and then opened fire when he saw Smith reaching for something.

and eye witness says Smith said this the moment before the shooting:

"Get out of here or I have a gun"


I mean, you don't have to wildly speculate here. He wasnt reaching for his insurance

Nobody on here really knows what happened but every post starts with either

A. Hayes being an a-hole

B. Smith being innocent

They were both clearly in the wrong at some point of the night. But because one played football it skews people's thoughts on a person.

Based on everything we've heard, and applying common sense, this is the most likely scenario (I'm not going to speculate why Hayes rammed Smith's car):

1. Hayes rear ends Smith's vehicle.

2. Smith and Hayes exit their vehicles and begin arguing. Neither gets farther than the door of their car, arguing over them like most often happens.

3. Hayes informs Smith that he has a gun and/or produces said weapon.

4. Smith informs Hayes he's not the only one with a weapon.

5. Smith stops arguing and returns to his vehicle, sitting in the driver's seat.

6. Hayes approaches Smith's vehicle with his weapon out to continue the argument.

7. Hayes sees Smith reaching for something in the glovebox or console and opens fire in a panic. This results in him shooting Smith in the back and his wife, who was in the passenger seat, gets hit in the leg by stray bullets.

8. Hayes calls 911 believing he was justified in the shooting because Smith was reaching for a gun, in his opinion.

Particularly the last one that reads:

NOLA.com photos show Smith's feet on the ground outside his truck. The pictures also show his arm over the steering wheel.

He wasn't sitting in his vehicle. He was likely standing at the driver's door.

Fine.

Smith tells Hayes he has a gun and then turns to reach into his vehicle. That's more than enough to make Hayes panic and shoot him.

This situation is fricked because most Saints fans are going to want to believe that Smith was killed in cold blood. That doesn't seem to be the case at all.


ETA: It's still murder IMO. You can't blame Hayes and his lawyer for coming at this from this angle though. They are trying to get a plea for manslaughter at worst, I'd assume.

Yea I agree. I think this is what happened.


If the eyewitness is accurate, Hayes didnt brandish a gun until Will Smith said he had one. It kind of kills the motive that Hayes was out to kill Smith that night.

I admit I haven't followed every little detail, but do we know that the guy who said this is an eye witness? Or was he just repeating what he heard? Maybe what Hayes said to police?

all of this should be an eye opener for everyone though. Road rage isnt worth losing your life over. I have been guilty of it myself, someone cut me off and i speed around them to flip the bird cussing... you just never know what the other drivers mental state is. I carry a gun everywhere i go, but never want to use it unless i absolutely have to. And i definitely do not want it to be over some dumbass road rage incident. Sometimes you just have to suck it up and let it go. But with the ego for a man sometimes that is a tough thing to do.

I think the DA ought to go for murder one. It's premeditated as hell. He rams Smith's car, gets out with a gun, and proceeds to light Smith up. That's 1st degree murder right there
