Blaming the owners/operators/franchisees that operate hot sheet motels instead of the pimps/trafficking organizations is as American as apple pie. It's another form of legal wildcatting by the plaintiff's bar.

The US Congress passed Trafficking Victims Protection Reauthorization Act (TVPRA), which created a private right of action for victims to sue their alleged traffickers. Pimps are generally judgment proof: the biggest pimp of all, Uncle Sam, takes their assets if pimps catch a charge. The TVPRA was later amended to include a private right of action against persons or entities that "knowingly profited from trafficking activities."

If you add up the TVPRA, state laws copying it, and common law torts (I'm not sure what duty a property owner really has to protect hoes against pimps or hoes against johns or hoes against other hoes), you have a potent mix of legal justifications for instituting a cash grab under the guise of a lawsuit.

What's attractive to the plaintiff's bar is that they are practically holding the major hotel chains by the balls, especially since there is some level of self-insurance that gets hit before any liability, excess or umbrella policies would (assuming that coverage exists).

Setting aside that the plaintiffs (aka the ex-hoes) will have a tough time proving actual damages, the facts that are unearthed by the litigation process are going to be incredibly damning/embarrassing for the hotel chains. So more often than not, the hotel chains pay up to avoid the litigation process.

The plaintiff's bar gets paid (and so do their pet congress critters). Meanwhile, the darkness and depravity on the edge of town will keep on keepin' on.

are the clerks at the motel supposed to call the cops every time they see a black guy with tattoos and a trashy white woman or something? are they supposed to be watching all of the security cameras 24/7?

eta: also, how many of these people are "traffickers" and not just local pimps? words like "trafficking", "rape", etc. are basically meaningless now.

Idk anything about trafficking, but I did stay at a Holiday Inn Express last night.

No, but if a 14 year old girl walks into the lobby with a 50 year old man who's obviously not his daughter...........

Now they're saying customers have been complaining for years and management ignored.

They now have an interactive map showing the actual customer reviews at each location.

Even Red Roof in Sulpher, LA has a bad review.

It really illustrates just how much of a turkey shoot this is for the plaintiff firms that do this sort of work.
