I blew a zero after driving and drinking one beer. Because I proved that I wasn't over the line I faced no consequences. Explain never blow if blowing will prove innocence.

So looking deeper is appears that I misspoke and hospitals do not charge for the legal blood draw. Cost of testing / labs is absorbed by the state.

Half right. Can’t use 894 again for ten years. And it reduces dui to reckless driving or similar so a lesser hit on insurance but still costly.

Blowing and performing the circus act only serves to provide evidence against you. No idea why anyone would do it voluntarily.

How in the hell does this work? I only crack window and then the officer creates a reasonable cause (which isn’t hard, especially if you’re driving erratically) and then they break you’re window and pull you out then haul to jail for a much likely longer stay in jail and probably hit you with multiple other charges like resisting arrest and multiple other driving violations they wouldn’t have done prior.

Seems like it would cost a lot more and take much longer to clear your name

I’m sure they spend a fortune, but is it probable they don’t get a charge? My sister keeps swearing he’s a good kid, but I want him to pay the price. He refused to blow and didn’t do their circus act test.


If money is not an issue it is unlikely that almost any traffic citation wasn't issued with some serious transgressions on the part of the officer...keep appealing until there are no appeals left....most jurisdictions would quit after a couple of appeals because it is to damned expensive.

Odds are pretty damn good if they have to take your blood test and you shell out for a good lawyer (you don’t need to pay more than 10k, even that is too much)

I uh…. Heard it from a friend.

A few years ago, I had a buddy who wouldn't blow so they took him to jail and charged with DWI.

Ultimately, he was fined, put on probation and had to install a device that...he had to blow in...each and every time he got behind the wheel for the next year.

He was embarrassed about it and would go to great lengths to disguise the process.
